These Individual User Terms and Conditions (“Individual Terms”) supplement, and are part of, the General Terms and Conditions and the Privacy Policy, and govern your individual user account and your use of the MagneticProxy proxy services (the “Services”), operated by ByteCrafted LLC, a company registered under the laws of Delaware (“MagneticProxy”, “us”, “we”, or “our”). In case of conflict between these Individual Terms and the General Terms and Conditions with respect to the Services, these Individual Terms control.
You must be at least 18 years old to use the Services. By using the Services, you represent that you are 18 or older. Before using the Services, you must affirmatively accept these Individual Terms and the Acceptable Use provisions below; we record the version accepted and the date and time of acceptance.
You must provide accurate and complete information when creating your account and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not share your account credentials with any third party. You must notify us immediately of any unauthorized access to or use of your account.
MagneticProxy provides rotating residential proxy services for lawful data collection and related business use. The Services are not a consumer VPN or an anonymity tool for evading the law, and may not be used to conceal unlawful activity. We may modify, suspend, or discontinue features of the Services at any time.
You may use the Services for lawful purposes only. You may not use the Services to violate any applicable law or regulation, to share your account credentials, to exceed the bandwidth limits or usage quotas of your plan, or to interfere with or disrupt the integrity or performance of the Services.
Without limiting the foregoing, you may not use the Services to: (a) access any computer, account, or network without authorization, including credential stuffing, brute-forcing, or account takeover; (b) engage in fraud, including payment, advertising, or click fraud; (c) distribute malware, ransomware, or phishing, or operate command-and-control infrastructure; (d) transmit, access, or distribute child sexual abuse material (CSAM) or any content that sexually exploits minors; (e) conduct denial-of-service attacks or send spam; (f) infringe intellectual property or breach the access controls or terms of any target website; or (g) engage in any other activity that violates applicable law. We prohibit only unlawful activity; lawful use consistent with these Individual Terms and applicable law is permitted.
You represent and warrant that you are not, and are not acting on behalf of, a person located in, ordinarily resident in, or organized under the laws of a comprehensively sanctioned jurisdiction (currently Cuba, Iran, North Korea, and the Crimea, Donetsk, and Luhansk regions of Ukraine), and that you are not on the U.S. Treasury OFAC Specially Designated Nationals (SDN) List or any equivalent list. You will not use the Services in violation of U.S. sanctions or export control laws. We may screen customers against sanctions lists and suspend or terminate accounts to comply.
Based on risk signals, we may require you to verify your identity and, for business customers, your business and its beneficial owners (KYC/KYB) as a condition of continued use of the Services. We may suspend access pending verification and terminate accounts that do not complete verification within the period we specify.
To provide the Services, prevent abuse, and optimize our network, we collect your IP address and connection logs, including request metadata such as timestamps and destination domains. You acknowledge that we may use automated analysis, including risk scoring, to detect abuse, fraud, and unlawful use, which may result in requests for information, verification, throttling, or suspension. Material adverse decisions are subject to human review. Our processing of personal data is described in the Privacy Policy.
Paid plans renew automatically for successive periods unless you cancel before the renewal date. You may cancel at any time; cancellation takes effect at the end of the current billing period. You are eligible for a refund only if you have used less than 20% of your data allowance or 1 GB, whichever is lower, and you request the refund within fourteen (14) days of payment.
We may suspend or terminate your account at any time, including for breach of these Individual Terms, the General Terms, the Acceptable Use provisions, or any applicable law. We may also suspend preventively, pending review, on a reasonable belief of unlawful or abusive use. You may request review of a suspension at appeals@magneticproxy.com, and we will respond within a reasonable period. Notwithstanding any suspension or termination, we may retain data and records as necessary for legal, compliance, evidentiary, or child-safety preservation purposes.
MagneticProxy retains all right, title, and interest in and to the Services and all associated intellectual property. If you provide feedback or suggestions about the Services, you grant MagneticProxy a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose without obligation to you.
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, secure, or error-free, and no method of transmission or storage is 100% secure. To the fullest extent permitted by law, MagneticProxy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services.
We may update these Individual Terms from time to time. We will notify you of changes by posting the revised Individual Terms on the Site and/or by email. For material changes, we will provide notice at least fifteen (15) days before they take effect and will require your renewed affirmative acceptance to continue using the Services. Your continued use of the Services after a change takes effect constitutes your acceptance of the revised Individual Terms.
These Individual Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Individual Terms shall be settled amicably or, if that is not possible, in the state or federal courts located in Delaware, USA.
